The problem is that fair market value can be anything you want it to be. While an assessor might tell you how much the house is worth, there are other factors, such as the location, any issues, and what décor you choose.

Of course, they do have the upper hand because they are going to offer what they think is fair and they know you are in a dire situation and want/need the money.
